Agreement to our Legal Terms
We are AUTOMARKA DIGITAL LLC ("Company," "we," "us," or "our"), a company registered in Wyoming, United States at 30 N Gould St Ste R, Sheridan, WY 82801. We operate the website https://automarka.digital (the "Site"), as well as any other related products and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services").
Automarka Digital is a comprehensive reputation management platform designed to help businesses elevate their online presence and build trust with consumers. Our services include:
- Automated Review Requests: We send professionally crafted text and email invitations, prompting satisfied customers to share their experiences on Google, social media, and other leading review sites. Our system uses proven messaging scripts and a strategic cadence, so you gather more authentic feedback with minimal effort.
- Reputation Monitoring & Insights: We track reviews and brand mentions across multiple platforms, providing you with real-time dashboards and alerts. This gives you a clear, consolidated view of your reputation, helping you address potential issues before they escalate.
- Professional Review Responses: Our team can respond to reviews on your behalf — thanking positive reviewers and addressing concerns from negative ones. This prompt, personalized engagement shows customers you value their feedback and care about their experience.
- Repurposing Reviews for Marketing: We take your best reviews and transform them into shareable social media content, highlight reels, and dynamic website widgets. This social proof helps drive more leads by showcasing your high-quality service where potential customers will see it.
- System Integrations: Our platform easily connects with your CRM, Google Business Profile, and social media accounts, allowing seamless automation and syncing of customer data. This way, you can send review requests automatically and centrally manage incoming reviews without juggling multiple tools.
These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and AUTOMARKA DIGITAL LLC, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms.
If you do not agree with all of these Legal Terms, then you are expressly prohibited from using the Services and you must discontinue use immediately.
The Services are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Services.
1. Our Services
The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Services from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.
2. Intellectual Property Rights
The Content and Marks are provided in or through the Services "AS IS" for your internal business purpose only. Subject to your compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable license to access the Services and download or print a copy of any portion of the Content to which you have properly gained access, solely for your internal business purpose.
Except as set out in this section, no part of the Services, Content, or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission. Any breach of these Intellectual Property Rights will constitute a material breach of our Legal Terms and your right to use our Services will terminate immediately.
By directly sending us any question, comment, suggestion, idea, feedback, or other information about the Services ("Submissions"), you agree to assign to us all intellectual property rights in such Submission. We shall own this Submission and be entitled to its unrestricted use and dissemination for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you.
3. User Representations
By using the Services, you represent and warrant that you will not use the Services for any illegal or unauthorized purpose and your use of the Services will not violate any applicable law or regulation. If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Services.
4. User Registration
You may be required to register to use the Services. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.
5. Purchases and Payment
We accept the following forms of payment: Visa, Mastercard, American Express, Discover, and PayPal. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Services. Sales tax will be added to the price of purchases as deemed required by us. We may change prices at any time. All payments shall be in US dollars.
We reserve the right to refuse any order placed through the Services. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.
6. Subscriptions
You can cancel your subscription at any time by logging into your account and initiating cancellation from within the platform. For security and fraud prevention purposes, cancellations must be initiated by the verified account owner or an authorized administrator of the Client's business. Automarka Digital may require reasonable verification before processing a cancellation request submitted through customer support. 7. Prohibited Activities
You may not access or use the Services for any purpose other than that for which we make the Services available. Prohibited activities include, but are not limited to: circumventing security features; tricking or defrauding us or other users; systematically retrieving data; making improper use of our support services; or using the platform to compete with us or for unauthorized commercial enterprises.
8. User Generated Contributions
The Services may invite you to chat, contribute to, or participate in blogs, message boards, online forums, and other functionality ("Contributions"). You retain full ownership of all of your Contributions and any intellectual property rights associated with your Contributions. However, by posting Contributions, you automatically grant us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide right and license to host, use, copy, reproduce, disclose, sell, publish, broadcast, and distribute such Contributions for any purpose.
Client grants Automarka Digital LLC permission to use the Client's business name, logo, trademarks, publicly available reviews and testimonials, and general performance results obtained through the Services for marketing and promotional purposes. If Client prefers not to have their brand used in marketing materials, Client may request removal by contacting [email protected].
9. Social Media & Third-Party Platforms
As part of the functionality of the Services, you may link your account with online accounts you have with third-party service providers ("Third-Party Accounts"). Your relationship with third-party service providers is governed solely by your agreement(s) with them. We are not responsible for reviewing Third-Party Content or Websites accessed through our Services.
10. Term and Termination
These Legal Terms shall remain in full force and effect while you use the Services. We reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the Services (including blocking certain IP addresses) and terminate or suspend your account for any reason or no reason.
11. Governing Law
These Legal Terms and your use of the Services are governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles.
12. Dispute Resolution
Binding Arbitration
Any legal action, claim, or dispute arising out of or relating to these Terms, the Services, or the relationship between you and Automarka Digital shall be finally resolved by binding arbitration, NOT by court proceedings. The arbitration shall be administered by JAMS under its Comprehensive Arbitration Rules & Procedures, or if JAMS is unavailable, by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

- Attorneys' Fees: In any dispute, action, or proceeding arising from these Terms, the prevailing party shall be entitled to recover all reasonable attorneys' fees, expert fees, court costs, and other expenses incurred in resolving the dispute.
Class Action Waiver
You agree that any arbitration or court proceeding shall be conducted on an individual basis only, not a class action, collective action, or representative action.
13. Disclaimer and Limitations of Liability
The Services are provided on an "as-is" and "as-available" basis. You agree that your use of the Services will be at your sole risk. To the fullest extent permitted by law, we disclaim all warranties, express or implied.
In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Services. Our liability to you for any cause whatsoever will at all times be limited to the lesser of the amount paid, if any, by you to us during the one (1) month period prior to any cause of action arising or $500.00 USD.
14. Client Responsibilities
You must have explicit permission from each End Customer before Automarka Digital sends them any SMS or email. Prior to uploading or providing any End Customer's contact information to the Service, you will have obtained all necessary and legally-required consents to contact that End Customer via the intended communication method, complying with laws such as the TCPA and CAN-SPAM Act.
The Client will be solely responsible for any legal consequences arising from improper use of the Services or failure to comply with applicable laws, and agrees to indemnify Automarka Digital for any loss or damage resulting from such misuse or non-compliance.
15. SMS Text Messaging & Opt-Outs
If at any time you wish to stop receiving SMS messages from us, simply reply to the text with "STOP". If you have any questions or need assistance regarding our SMS communications, please email us at [email protected] or call at (833) 424-1395.
16. Data Use & Storage
When a Client cancels their account, Automarka Digital does not automatically delete the Client's data or account information, allowing Clients to easily reactivate their accounts. However, Clients may submit a written request to permanently delete ("purge") all personal and account data from our systems by emailing [email protected].
